New Jersey is moving forward with implementing its new data privacy legislation by seeking public comments on proposed rules that outline how consumer data must be protected under the state’s recently enacted law.
These rules are designed to enforce the New Jersey Data Privacy Act, which was signed into law by Governor Phil Murphy in January 2024 and officially took effect on January 16, 2025. The law applies to businesses that control or process the personal data of a substantial number of consumers in New Jersey.
The New Jersey Attorney General’s Office holds exclusive authority to enforce the law. In a statement, Attorney General Matthew Platkin emphasized the importance of strengthening data protections, noting that the proposed rules aim to ensure transparency around how websites, online services, and other entities handle consumer data. The rules would also require these entities to notify consumers of their privacy rights and provide guidance on how to exercise those rights.
The proposed rules would establish a regulatory framework based on the key provisions of the New Jersey Data Privacy Act. Among the primary requirements:
- Notification and Opt-Out: Businesses must inform consumers when personal data is collected or disclosed to third parties and provide a mechanism for consumers to opt out of such practices.
- Access and Correction Rights: Consumers must be able to access the personal data held by a controller and request corrections or deletion of inaccurate or outdated information.
- Data Minimization: Controllers are required to limit data collection to what is adequate, relevant, and reasonably necessary for specified business purposes.
The proposed regulations also reinforce consumer rights by ensuring that individuals can opt out of the sale of their personal data or its use in targeted advertising, and correct any inaccuracies in the data held by businesses.
Public Comment Period
The state is accepting public feedback on the proposed rules through August 1, 2025. Interested parties are encouraged to review the proposal and submit comments before the deadline.
