Empowering Privacy: FTC’s 2023 Update on Safeguarding Consumer Data 

The Federal Trade Commission (FTC) has recently released its Privacy and Data Security Update for 2023, offering insights into its efforts to safeguard consumer privacy in an era of rapidly evolving data usage. The report highlights the FTC’s proactive stance in protecting consumers against indiscriminate data collection and exploitation by companies. 

Key highlights from the report include: 
  • Enforcement Actions: The FTC has been proactive in taking legal action against companies that violate consumer privacy. Notable cases include Amazon Alexa’s alleged violation of the Children’s Online Privacy Protection Act (COPPA) and Rite Aid’s mishandling of AI facial recognition technology.
  • Health Privacy: Protecting sensitive health information remains a top priority for the FTC. Recent actions include banning BetterHelp and GoodRx from sharing health data with third parties for advertising purposes.
  • Children’s Privacy: Through enforcement of COPPA, the FTC has targeted major gaming and education technology companies to ensure the protection of children’s personal information. Proposed changes aim to further strengthen COPPA rules.
  • Geolocation Data: Recognizing the sensitivity of location data, the FTC has taken action against companies like Kochava Inc. for selling geolocation data that can compromise individual privacy.
  • Data Security: The FTC has actively pursued companies failing to implement adequate data security measures. Recent enforcement actions include cases against Global Tel*Link, Drizly, Chegg, and CafePress.
  • Fair Credit Reporting Act (FCRA) Compliance: The FTC ensures companies adhere to the Fair Credit Reporting Act, which mandates standards for using data in credit assessment, insurance eligibility, employment suitability, and tenant screening. With 117 FCRA cases, the FTC has levied over $137 million in civil penalties. Notably, in 2023, the FTC and Consumer Financial Protection Bureau pursued Trans Union LLC and a subsidiary for inaccuracies in tenant screening reports, hindering consumers’ housing prospects.
  • Rulemaking and Policy Work: In addition to enforcement, the FTC has proposed rule changes to strengthen regulations regarding health data breach notifications, COPPA, and surveillance practices. A policy statement emphasizes protecting children’s privacy rights in remote learning settings.
