Consumer litigation activity remained elevated in June 2026, with filings under major consumer protection statutes showing mixed month-over-month trends, according to the latest WebRecon Litigation Report. While some categories experienced slight declines, year-to-date litigation remains significantly higher than the same period in 2025.
The report highlights continued increases in lawsuits filed under the Fair Credit Reporting Act (FCRA), Telephone Consumer Protection Act (TCPA), and Fair Debt Collection Practices Act (FDCPA), along with elevated complaint activity submitted to the Consumer Financial Protection Bureau (CFPB).
FDCPA Lawsuits Decline in June but Remain Ahead of 2025
Fair Debt Collection Practices Act (FDCPA) lawsuits decreased 5.5% in June, with 364 cases filed. Despite the monthly decline, filings remain 12.1% higher year-to-date than during the same period in 2025.
Putative class actions accounted for 27 FDCPA lawsuits, representing 7.4% of all FDCPA filings during the month.
TCPA Litigation Continues to Be Driven by Class Actions
Telephone Consumer Protection Act (TCPA) lawsuits increased 1.2% in June, reaching 250 filings. Year-to-date, TCPA litigation is up 34.3%.
Class action activity continues to make up the majority of TCPA cases. In June, 191 lawsuits—or 76.4% of all TCPA filings—were filed as putative class actions. While this was slightly lower than May’s 80%, it remains exceptionally high compared to historical trends.
FCRA Lawsuits Post the Largest Monthly Increase
Fair Credit Reporting Act (FCRA) lawsuits experienced the largest month-over-month increase among the three major consumer protection statutes. June filings rose 16.5% to 981 lawsuits.
Year-to-date, FCRA litigation has increased 43.1%, continuing the strong upward trend seen throughout 2026. Putative class actions represented just 18 filings, accounting for 1.8% of all FCRA lawsuits filed during the month.
CFPB Complaint Activity Remains Elevated
Consumer Financial Protection Bureau (CFPB) complaints declined slightly in June, falling 1% to 27,054 complaints. However, complaint volume remains substantially higher than last year, with year-to-date complaints up 30.4%.
The reported debt categories associated with June CFPB complaints included:
- I do not know: 18,341 (68%)
- Credit card debt: 2,756 (10%)
- Other debt: 2,693 (10%)
- Rental debt: 940 (3%)
- Telecommunications debt: 938 (3%)
- Medical debt: 562 (2%)
- Auto debt: 449 (2%)
- Payday loan debt: 192 (1%)
- Federal student loan debt: 70 (less than 1%)
- Private student loan debt: 63 (less than 1%)
- Mortgage debt: 50 (less than 1%)
Looking Ahead
Although June produced mixed month-over-month results, litigation activity under the FDCPA, TCPA, and FCRA continues to outpace 2025 levels. The sustained increase in filings—particularly under the FCRA and TCPA—along with elevated CFPB complaint volumes, reflects an active consumer litigation environment that organizations should continue to monitor.
